What to Do After a Hit and Run Accident
California Vehicle Code § 20001 turns fleeing the scene of a collision that causes death or serious injury into a felony, with potential prison time and a mandatory license revocation on top of the civil exposure. For the family of a pedestrian killed in a hit-and-run, the legal path runs on two parallel tracks. The criminal case belongs to the Los Angeles District Attorney, while a wrongful death claim under California Code of Civil Procedure § 377.60 belongs to the surviving spouse, registered domestic partner and children, and in some circumstances to anyone who was financially dependent on the victim. That civil clock runs for two years under CCP § 335.1.
Even when the driver is never caught, a recovery is often possible: California’s uninsured motorist (UM) coverage reaches hit-and-run crashes, and a pedestrian who lived in a household with auto insurance can usually tap the UM coverage on that policy. Our Los Angeles pedestrian accident lawyers file preservation letters on nearby business cameras, Ring doorbells and LADOT traffic cameras within hours, because that footage often cycles over in 72 hours. Our wrongful death team handles the § 377.60 side, and the firm serves families across Los Angeles when a loved one is killed on their own street.
