Who’s Entitled to Claim Compensation When Someone Dies in a Multiple Car Crash?
In Los Angeles, when someone dies in a multiple-car crash, certain individuals are entitled to claim compensation through a wrongful death lawsuit. The people who typically have the right to make such a claim include:
- The surviving spouse or domestic partner: They are usually the first in line to file a wrongful death claim.
- Children of the deceased: Biological and adopted children have the right to seek compensation. If the deceased had minor children, they are typically entitled to support.
- Parents of the deceased: If the deceased had no spouse, domestic partner, or children, the parents might be entitled to file a claim.
- Siblings or other relatives: If none of the above individuals exist, more distant relatives, such as siblings or grandparents, may have the right to claim compensation.
- Financial dependents: Anyone financially dependent on the deceased, even if not related by blood or marriage, may also be eligible to file a claim.
Compensation in such cases can cover various losses, including funeral and burial expenses, loss of financial support, loss of companionship, and emotional suffering. It’s important to consult a Southern California car accident attorney to determine eligibility and navigate the legal process.
