What Are My Rights After a Multiple Car Crash in California?
If you are involved in a multi-car crash in California and wish to claim compensation, you have several rights under state law. Here’s what you should know:
- Right to Compensation: You can seek compensation for medical expenses, lost wages, property damage, and pain and suffering. Depending on the circumstances, you can file a claim with your insurance company, the at-fault driver’s insurance, or both.
- Comparative Fault: California follows a “pure comparative negligence” rule. This means you can still recover damages even if you were partially at fault for the crash. However, your compensation will be reduced by the percentage of your fault. For example, if you were 20% at fault, you would receive 80% of the total damages.
- Right to Evidence: You can collect and present evidence to support your claim. This includes police reports, witness statements, photos of the scene, medical records, and other documentation proving liability and the extent of your damages.
- Right to Legal Representation: You can hire an attorney in negotiations with insurance companies or courts. An attorney can help ensure your rights are protected and that you receive fair compensation.
- Statute of Limitations: In California, you generally have two years from the accident date to file a personal injury lawsuit. If the claim is for property damage only, the statute of limitations is three years. Please file within this time frame to avoid losing your right to compensation.
- Insurance Requirements: California law requires all drivers to carry minimum liability insurance. This is intended to cover damages in the event of an accident. If the at-fault driver is uninsured or underinsured, you may be able to claim compensation through your insurance policy if you have uninsured/underinsured motorist coverage.
It’s recommended to consult a Southern California car accident attorney to guide you through this process. A lawyer can also calculate how much compensation you can receive, all the damages you suffered, how long your claim would take, and much more. Gain peace of mind and maximize your chances of obtaining the highest award you’re owed by law.
