Is it Possible to Claim Compensation when a Bicyclist Dies in a Hit and Run?
Yes, it is possible to claim compensation when a bicyclist dies in a hit-and-run accident. The family or legal representatives of the deceased can pursue a wrongful death claim to seek compensation for their loss. This type of claim can cover various damages, including:
- Funeral and Burial Expenses: The costs associated with the funeral and burial of the deceased.
- Loss of Financial Support: Compensation for the financial support the deceased would have provided to their family.
- Loss of Companionship: Damages for the emotional pain and suffering caused by the loss of a loved one.
- Medical Expenses: If the victim incurred any medical costs before their death, these can also be claimed.
- Punitive Damages: In cases of gross negligence or intentional harm, punitive damages may be awarded to punish the wrongdoer.
To pursue compensation, the family typically needs to file a wrongful death lawsuit against the responsible party. If the driver is unidentified or uninsured, the family may be able to seek compensation through the deceased’s own insurance policy, such as through uninsured/underinsured motorist coverage.
Given the complexities involved in these cases, consulting with a California bicycle accident attorney is advisable to navigate the legal process effectively.
